Definitions

For the purposes of these Terms and Conditions:

Company refers to Ni vCard, operating in the Sultanate of Oman.
Service refers to the Ni vCard website, application, and digital business card platform.
User / You refers to any individual or entity accessing or using the Service.
Website refers to the official Ni vCard website.
Application refers to any web or mobile application operated by Ni vCard.

Acknowledgment

These Terms and Conditions govern your use of the Service and constitute a legally binding agreement between You and the Company.

By accessing or using the Service, You agree to comply with and be bound by these Terms. If You do not agree with any part of these Terms, You must not access or use the Service.

You confirm that You are at least 18 years of age. The Service is not intended for use by individuals under 18.

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with applicable laws in the Sultanate of Oman.

Use of the Service

Termination

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

To the maximum extent permitted under applicable laws of the Sultanate of Oman:

The Company shall not be liable for any indirect, incidental, special, or consequential damages.
The total liability of the Company shall be limited to the amount paid by You for the Service, or OMR 100, whichever is lower.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied.

Ni vCard does not guarantee:

Continuous or uninterrupted availability
Error-free operation
Compatibility with all devices or software

Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the Sultanate of Oman, without regard to conflict of law principles.

Dispute Resolution

In the event of a dispute, You agree to first attempt to resolve the matter amicably by contacting the Company.

If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of the Sultanate of Oman.

Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

Failure to enforce any right shall not constitute a waiver of such right.

Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated where reasonably possible.

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
